USOE Ell Forms Rules ENGLISH LANGUAGE LEARNER FORMS DATABASE The purpose of the ELL FORMS DATABASE is to provide Utah Districts and agencies with a quick, effective way of locating special education and related forms that may exist in various languages. These forms are not housed at the Utah State Office of Education (USOE), or the Utah Personnel Development Center (UPDC), or on this web site. Instead, district-to-district contact information can be accessed on the ELL FORMS DATABASE, and forms obtained directly from the hosting district. The database has a search feature with a pull-down menu of forms that may be available. Search by language or form. Federal statutes and Utah State Board of Education Special Education Rules (Aug. 2001) require school personnel to provide written information to parents in their dominant language. All written communication with parents must be in a language and mode of communication that the parents understand. Rulings from the U.S. Office of Civil Rights (OCR) confirm a schools’ responsibility to notify national origin minority parents of all school activities shared with other parents in their native language. Lack of district forms or available interpreters cannot be used as an excuse for not providing these services. SERVICE DELIVERY III.F.PARENT PARTICIPATION 4. “The LEA shall take whatever action is necessary to ensure that the parent understands the proceedings at the IEP meeting, including arranging for an interpreter for parents with deafness or whose native language is other than English. “ (USOE Rules, p. 43) III.S. PARENT INVOLVEMENT IN PLACEMENT DECISIONS 5. “The LEA shall make reasonable efforts to ensure that the parents understand, and are able to participate in, any group discussions relating to the educational placement of their student, including arranging for an interpreter for parents with deafness, or whose native language is other than English.” (USOE Rules, p. 54) IV.D.PRIOR NOTICE 3. “The notice required under this section must be: b. Provided in the native language or other mode of communication used by the parent, unless it is clearly not feasible to do so. 4. If the native language or other mode of communication of the parent is not a written language, the LEA shall take steps to ensure that: a. The notice is translated orally, or by other means, to the parent in his or her native language or other mode of communication. b. The parent understands the content of the notice. c.
